Bijzondere vraagstukken in Person- en familierecht

This course deals with the impact on personal and family law of human rights as protected by the European Convention on Human Rights, through an analysis of the Strasbourg jurisprudence. A description is made of the control and interpretation mechanisms used by the European court in Strasbourg, as well as of the main principles and concepts of its jurisprudence. Throughout the course, the students will learn the importance of human rights in this field as well as others. As the Strasbourg jurisprudence on family law cannot be covered comprehensively, a selection is made of the relevant decisions on certain issues (e.g. adoption by homosexual couples). The teacher hands out a course book at the beginning of the course, and students are asked to prepare each coming class by studying the decision that will be analysed, so that a suitable rhythm and level of teaching can be reached and maintained.

This additional language module will essentially be geared towards verbal interaction and the reinforcement of oral language skills. It will tackle various language functions such as giving a structured presentation, expressing an opinion and arguing a point.
It will cover law-related topics and vocabulary, without focusing on one specific branch nor on highly technical terminology.
This module will also promote the students' practice of basic grammar structures, in order to improve oral fluency.

The course's objective is to enable students to actively follow law classes taught in Dutch. The content of the course is used as a pretext to teach written and spoken Dutch. Students must take an active participation during class (ongoing evaluation) and will learn, in addition to everyday Dutch, the specific vocabulary related to human rights (in Dutch, English, and French).
Skills developed: understand a legal text drafted in a language other than French and summarise it in French; take part in simple conversations related to familiar or personal subjects; identify a legal reasoning and provide an opinion; understand the need for accuracy in legal language.

• improved their oral fluency through a series of exercises and activities related to law designed to elicit conversations and discussions;

The course builds upon the legal course in a foreign language, which is also offered during the 1st and 2nd year of the bachelor programme.
Minimal knowledge of Dutch and family law is required. Specific knowledge in the field of human rights is not a prerequisite, but students should have an interest in this branch of law.

(Inter)active analysis of the ECHR's jurisprudence. Eight two-hours classes.

• Oral activities such as discussions, role playing, presentations, debates on legal topics presented through short videos.
• Practical exercises to reactivate, assimilate and use legal vocabulary.
• Drill exercises in order to put basic grammar structures into practice and improve oral fluency.

Classes are interactive and the students' active participation is required. Students must learn to discuss a law topic in Dutch, and emphasis is therefore placed on oral communication skills rather than on writing. The teacher will adjust to each student's starting level, and the oral exam will take students' personal progress into account.

This module is offered during one term, with ten weekly 90-minute classes.
Attendance is compulsary. Students will prepare the activities and exercises planned for each class. Regular attendance and active participation are essential.

 Rather than a traditional oral examination, this course's exam consists in a dialogue on a legal issue. First, students must give an oral answer to a question on the theory studied in class, after having prepared their answer in writing. Then, students are evaluated based on their ability to express themselves in Dutch on a topic of their choosing (legal decision, text, poetry, song lyrics, etc.) that must be related to human rights and family law. It is important that the message communicated by the student be clear. The evaluation will also take into account the students' presence and participation in class (ongoing evaluation). This legal component of the exam makes up 75 % of the mark for this course, and the remaining 25 % are evaluated by Ms De Laet for the course's language component.

• het beginsel van de permanente evaluatie wordt blijvend toegepast, alle prestaties van de student, zowel deze tijdens de 5 live colleges als deze verricht tijdens de lockdown (schriftelijke analyse van 2 arresten) tellen mee voor het globale puntencijfer van de student; 
• op maandag 20 april 2020 werd het laatste onderdeel van de syllabus gepubliceerd  (2 bestanen) via  "Les nouvelles" en tevens een laatste kleine video van 10 minuten (via Podcast) waarin wordt uitgelegd wat van dat laatste cursusonderdeel belangrijk is voor de evaluatie (verwijzing naar de zogezegde "examenfiches") en waarin de cursus aldus besluitend, een opsomming wordt gegeven van de 5 topics die tijdens het academiejaar werden behandeld;

• de klassieke mondelinge examens die voor de Coronacrisis gepland waren hetzij op 14 mei, hetzij op 11 juni worden opgeheven en vervangen door een mondelinge evaluatie die op "digitale" wijze (via Skype ou par Lifesize) zal plaatsvinden in beginsel in mei en voor de aanvang van de officiële zittijd van 18 mei (om op die wijze de druk van het aantal tijdens de officiële zittijd te organiseren examens te verminderen) (zie mail aan studenten gericht op 14/04)
• omdat ondanks de Coronacris op 18 april bleek dat geen onderwijs-, noch evaluatie-activiteit mag plaatsvinden tijdens de officiële blokweek (van 11 tot 17 mei), impliceert de voorgaande paragraaf dat voor die mondelinge evaluatie data tussen 1 en 10 mei zullen worden voorgesteld aan de studenten, en voor de studenten voor wie die data in mei echt onoverkomelijk zouden zijn, data eind juni  (zie mail en 'nouvelle' gericht aan de studenten op 18/04);   
• teneinde de exacte datum van die mondelinge evaluatie te bepalen, zal een Doodle met  datavoorstellen de studenten worden gericht ;  
• wat het voorwerp van die mondelinge evaluatie betreft, heeft elke student, gelet op het korte tijdsbestek waarover hij beschikt, de individueel te maken keuze tussen de 2 volgende mogelijkheden: a) de voorstelling in het Nederlands door de student gedurende 10 minuten van de tekst die hij wellicht reeds heeft gekozen of voorbereid (en die beantwoordt aan de examenvereiste waar elk college op werd gehamerd, zie podcast van 19/04) en de docent stelt daarover een vraag b) de realisatie van een examen in de Open Book- vorm : de docent stelt een aantal vragen over de behandelde materie (4 arresten en een laatste topic over HUDOC en statistische gegevens werden behandeld en telkens werd aangegeven wat essentieel is) en de student antwoordt in het Nederlands, hiertoe mag hij al het cursusmateriaal gebruiken tijdens de 12-tal minuten durende videoconferentie (zie podcast hierover gepubliceerd op 20/04).
