Learning unit contents

The lectures series « Fondements de droit belge : aspects de droit privé » aims to give Erasmus students a general overview of the principles of Belgian private law.

Learning outcomes of the learning unit

The course's main purpose is to shed light on some aspects of Belgian Private Law, especially with regard to property rights. It also provides an opportunity for foreign Law students to deepen the Law terminology in the French language.

Prerequisite knowledge and skills

This course is dedicated to international or Socrates-Erasmus Law students; a sufficient knowledge of the French language is required.

Planned learning activities and teaching methods

The course will cover the following topics:

1 - The first lecture will be dedicated to an introduction to the Belgian legal and judicial system, which will allow students to learn more about their host country and to better understand the context in which the norms they will study were adopted;
2 - During the second week, we will directly delve into Belgian property law, and specifically focus on the transfer of property rights, since fundamental differences exist in that regard among European legal orders. Attention will moreover be drawn to other existing rights in rem and to land registration and publicity;
 3 - The third and fourth weeks will be entirely dedicated to an introduction to Belgian contract law, including a brief focus on evidence law;
4 - The fifth lecture will give students an overview of Belgian tort law;
5 - The sixth and seventh lectures will cover the essentials of Belgian labour law, focusing on the individual contractual relationship between employer and employee and on trade unions and the right to strike, respectively;
6 - The last lecture will be dedicated to Belgian nationality law ;
7 ? - If there is enough time, a lecture will be dedicated to the specificities of the Belgian inheritance law.

Finally, the floor will be given to the students themselves, who will have to give a 15 minutes presentation on a topic related to Person or Family law and subsequently moderate a brief debate with the other students.

Mode of delivery (face to face, distance learning, hybrid learning)

The course consists of 12 lectures taking place every Wednesday (2-4pm) at the University. Nervertheless, if the situation requires it, the lesson will be given via eCampus (online courses). Depending on the number of subscribers, I am expecting active participation from all students; this way, we will be able to both improve your French oral expression and to have rewarding exchanges and confront the norms from your own legal orders with Belgian law.

Organisational adjustments related to the current health context

Recommended or required readings

Prior to each lecture, a power point presentation including the essentials of the studied topic will be uploaded on eCampus (expect for the first lesson).

Assessment methods and criteria

Below you will find information on the evaluation methods planned for in-person and remote exams as well as those planned for hybrid sessions. Depending on how the health crisis evolves, the chosen method will be communicated to you no later than one month before the start of the exam session.

Any session :

- In-person

oral exam

- Remote

oral exam

- If evaluation in "hybrid"

preferred in-person

Additional information:

Students will be evaluated on two bases:

  • First, they will receive a grade for giving a presentation in class on a topic of their choice related to Person or Family law (a list of topics' suggestions will be submitted during the first lecture) in both their national law and Belgian law (comparative law), and moderating a brief debate on that same topic with the rest of the class;
  • Second, they will have to present an oral exam in June, whose specific terms will be later established after discussion with the students. The topics covered during this oral exam will be those examined during the lectures, which is why attendance in class is highly recommended to all students.
