Learning unit contents

The course is taught in German and is organized in two parts :
- in the first part, the course will focus on the legal discipline; it will be taught by a law professor, in German ;
- in the second part, language support is offered by a linguist (operating with the ISLV), in close contact qith the relevant law professor.

The Belgian non-criminal legal system and the major instrument in civil litigation regulations, i.e. the judgement, are both studied in German in this 15-hour course, divided into two- to three-hour units, from a linguistic point of view and in terms of fundamental teaching.
The lessons are based on relevant articles from the Judicial Code, and on key judgements made by the Court of Cassation in Belgium, and closely follow the teachings of the Messrs Fettweis and Leval.

Learning outcomes of the learning unit

To provide law students with essential knowledge for their know-how as future lawyers, relating to the settlement of conflicts in civil law through the judicial method, and with the appropriate German technical vocabulary used in Belgium.

At the end of the course students will have a better command of legal German. They will have improved their oral communication skills. They will be better prepared to give efficient oral presentations. They will also have improved their listening comprehension skills.

Prerequisite knowledge and skills

The course follows and builfs upon the course of "foreign language in a legal context", which is part of the programm of the first and the second holder of bachelor in law.

Students should have a good command of German corresponding to CEFRL level B2.

Improving students command of legal German
Conversation exercises and language exercises based on legal texts or legally oriented texts.
Listening comprehension
Each student will give an oral presentation in class.

Students are expected to prepare their lessons and to participate actively in class.

Since the course also has a linguistic vocation, the oral lessons are amply structured and written up on the board, so that students can compile their own notes while exercising their knowledge of the language. The treaty in French by Professor G. de Leval on the "Elements of civil procedure" is the work of reference. A syllabus entitled "Belgisches Zivilprozessrecht. Sonderfragen" also exists.

Assessment methods and criteria

Each student will obtain a global mark for the course, wich consists of two separate grades, one for each section of the course, as follows :
- 3/4 of the global mark for the legal part;
- 1/4 of the global mark for the language support part.
A student who obtain a grade equal or lower than 8/20 for one of the two components, is not entitled to obtain more than 9/20 for the global mark.
An exemption for the language support part can be obtained for the second examination session.
No partial exemptions can be obtained for one or the other section of the course, from one year to the next.

The assessment is divided into two parts. Firstly, students are assessed on their regular intellectual commitment in class. Secondly, this desire to progress is complemented by an individual discussion concerning the themes studied in class.

Continuous assessment of progress:
- an in-class presentation 2/5
- a written test  3/5
Class attendance is compulsory.
Note:
The continuous assessment mark will be taken into account for both exam sessions.
Mere exam attendance (without actually taking part in the exam) will lead to a global mark of 0.
