The course is built around a number of true-to-life Community law problems encountered by the Dutch brewery N.V. Verenigde Brouwerijen Limburg (VBL), when it tries to sell its delicious speciality beer L'amour fou (Crazy Love) and some of its other amazing beers in Austria, Italy, Greece and Spain, Poland and when it is accused of anti-competitive behaviour on the Community market. The course also deals with the heartbreaking problems encountered by the Irish lawyer Patrick Fitzpatrick when he and his families move to the Netherlands to live and work in this reputedly very hospitable country. Finally, we try to solve the difficult problems of the law firm Zeergoot. The course consists of 7 interactive lectures of two hours and seven seminars of two hours each. The seminars are devoted to the discussion of the problems encountered by the Verenigde Brouwerijen Limburg (VBL), the Fitzpatrick family and the law firm Zeergoot. In order to make the seminars as interesting and useful an experience as possible, you are expected to prepare for the seminar discussions in writing. Much of your work as a lawyer will consist of writing short but well-reasoned briefs on legal problems submitted to you for your advice. The written preparation for the seminars are to be handed in at the beginning of the seminar meeting and on ELEUM.

Acquis d'apprentissage (objectifs d'apprentissage) de l'unité d'enseignement

The purpose of this course is to introduce students to the core of what is known as the "Substantive Law" of the European Union. The course deals with the free movement of goods, persons, services and capital as well as the freedom of establishment, cartel agreements and concerted practices, the abuse of a dominant position, mergers, state monopolies, state aids and the enforcement of competition law.

The written preparations account for 1/4 of the final grade. 3/4 of the grade is based on a written examination consisting of three questions.
