Learning unit contents
The title of the 2021-2022 seminar is: "Mallarmé, Theorist of the State and of Law?"
Rather than examining a canonical work of political or legal thought, the aim of this year's seminar is to explore the possibility that texts other than those from legal dogmatics may shed light on certain recurrent questions in the general theory of law - in particular, those of the 'nature' of the State and of law.
While the 'Law and Literature' movement has already made use of some of the great works of the world's literary heritage, it seems that the form of the novel has most often been favoured. Poetry and the aesthetics of poetry, on the other hand, do not seem to have been explored much so far.
It is therefore on the work of a writer renowned for his difficulty and a priori very distant from any reflection on the theory of law or the fundamental sociology of the State that attention will be focused in this case: Stéphane Mallarmé. In order to do this, students will be invited to read certain texts, to present them and to discuss them.
Beforehand, during the first session (9 February 2022), an introductory lesson will be given and the division of work between students will be discussed.
The seminar will benefit from the presence and interventions of Professor Pascal Durand (U.Liège), a renowned specialist of Mallarmé. The starting and concluding questions are: what can a legal theory's view of a poetic text shed light on the State and the prerogatives reserved for the poet, and what light can poetry shed on legal theory, which is itself considered to be very far removed from any poeticity?
The texts studied during the seminar will be sent to students during the first quadrimester.
