Learning unit contents

The course involves the analysis of European civil procedure, i.e. the main instruments adopted by the European Union that form 'European procedural law' (circulation of court decisions, obtaining enforceable titles, common procedures, obtaining evidence of proof abroad, transboundary notification and reporting, etc.).

Learning outcomes of the learning unit

The principle of the free movement of goods, services, capital and people encourages the mobility of European citizens and, in particular, the development of trade activities within the entire European Union. Situations with transboundary implications are therefore increasingly frequent, especially in a country like Belgium, owing to its central location in Europe and its small size. The aim of the Civil Procedure course is to enable students to acquire knowledge about the different instruments relating to European civil procedure. By the end of the course, students should be able to identify and solve relevant procedural issues in the event of a 'European dispute'.

Prerequisite knowledge and skills

Command of the bases of Belgian civil procedural law and private international law.

Planned learning activities and teaching methods

Teaching is divided into several parts.
The first part will consist of lecture-style teaching sessions, devoted to a general presentation of the European legal area.
The second part will be reserved for the study of files and practical cases. Professional specialists will contribute towards the discussions. At these times, interaction with the students will be encouraged.
Finally, the third part will require the compulsory active participation of students. Students will have to orally present a subject (a legal decision, a practical case, a specific question, etc.). As early as possible during the year, students will choose their subject in agreement with the teaching staff. At a specific date, students will submit an email with the outline of their thoughts, which will be presented orally to the class on a specific date. During the presentations, the teaching staff will ask additional questions and for further information.

Mode of delivery (face-to-face ; distance-learning)

The course is taught face-to-face. It will take place during the first term on Tuesdays, from 14:00 to 16:00.

Assessment methods and criteria

Students will be assessed on the basis of two presentations:
- the presentation mentioned above in the section "Teaching methods" (50% of the overall mark);
- an oral exam covering the entire subject (50% of the overall mark).
Students who do not submit their written outline or who do not carry out their oral presentation during the year on the set date will not, under any circumstances, pass the exam at the first session. During the second session, they will be asked to submit their written plan no later than 15 August and to orally defend their plan on the day set for the oral exam. The same rule applies to students who fail the exam at the first session.
