Learning unit contents
The subject of the course is the consequences of pronounced judgments of the Council of State. The question is: is it possible to do a new administrative act when it is annulled and how to do it? The course will also talk about the responsibility of the executive power; the Human Rights influence and the last Council of State's reform in 2014.
Learning outcomes of the learning unit
One of the course's aims is to make the students sensitive to the importance of elaborating an administrative litigation strategy. Theoretical thoughts (analysis of case law) and real-life cases are both discussed in the lecture (drafting of appeals).
Prerequisite knowledge and skills
Administrative Law and Constitutional Law.
Planned learning activities and teaching methods
A visit to the Council of State will be organized.
Mode of delivery (face-to-face ; distance-learning)
Oral presentations, lectures and discussions with students.
The students prepare the course by reading (judgments, doctrine,...) or by writing a draft of the appeal.
