Course contents :
In this course, we will analyse the European Court of Huamn rights' case law by themes, critically, and in English.
Our goal is twofold. On one hand, the course aims at identifying the Court's position as regards a few fundamental issues for the European society (homosexuality, the prohibition of death penalty, or the freedom of expression, for instance). On the other hand, the course aims at discussing limits and forces of the (European) system of human rights, upon the basis of papers critically approaching such system.
Learning outcomes of the course :
This course completes other general courses on human rights, by providing students with an overview of different rights guaranteed by the Convention, and of their (doctrinal and critical) interpretation.
It aims at improving our knowledge of the European system of human rights, of critical approaches to human rights, and of legal English.
Prerequisite knowledge and skills :
Knowledge of the Convention, its history, the fundamental principles governing its interpretation and the work of the European Court of Human Rights.
Students' aptitude to follow a course in English, participate in a discussion and deliver an oral presentation in the English language.
Planned learning activities and teaching methods :
Students read cases or papers to be commented before coming to class.
Those who want to may present some cases or papers.
Everyone is invited to intervene in discussions and debates.
Mode of delivery (face-to-face ; distance-learning) :
The course will be delivered by Diane Bernard but interspersed by students' presentations, and debates based on papers and cases to be read in advance.

Extracts of cases and papers, available online for the students.
Assessment methods and criteria :
The exam is oral (and in English). It covers everything that was said in discussed in class, as well as the content of the syllabus (extracts of cases and papers).
Students who present a case or paper in class, and/or intervene much in debates, might be granted a +1 to +3 point bonus.
