Course contents :  
  • in one part, Me Deliège will lead an examination of the provisions of the Notarial organic act as it relates to drafting all notarised acts and the provisions of the anti-money laundering law in relation to the notarial ministry
  • in another part, Me Declairfayt will present:
  • first, the probative force of the deed drafted by the notary (how is it an instrument of proof - of what is it evidence and vis-à-vis whom - what is the value of copies, annexes - what should be done in the event of invalidity, loss, etc.)
  • second, the enforceability of this deed (how does the deed drafted by the notary allow for enforcement without court proceedings).
Learning outcomes of the course :  
  • Me Deliège: to raise student awareness of the importance of identifying persons and things and of the various formalities required of the Notary when drafting a notarial act
  • Me Declairfayt: to give the students an opportunity to grasp the importance of the deed drafted by the notary and to see how it differs from deeds drafted by other legal professionals.
Prerequisites and co-requisites/ Recommended optional programme components :  
Law of successions, contracts, evidence and enforcement

  • the course follows the opening of a file
  • many examples are given in the course and appear in the notes.

Recommended or required readings :  
  • for drafting deeds: course notes and samples are given to the students;
  • for probative force: a detailed outline of each chapter in the course will be made available
  • for enforceability: written course notes are available (+/- 50 pages).
Assessment methods and criteria :  
  • Me Deliège: Written examination (drafting a legal document).
  • Me Declairfayt: Oral exam/Question based on an actual case and application of principles.
