| Course contents : | This course has to do with the main principles of international humanitarian law (IHL) or the law of armed conflict.
In the course of twenty class meetings that will be held between September and December - seminars during which various lecturers will come to discuss their areas of expertise - we will take up principally the question of qualifications of conflicts, the notion of protected persons, methods and means of authorized conflict, questions connected to the operation of IHL, but also international penal law and the International Criminal Court. The interactions between IHL and human rights and the rights of refugees will also be discussed, as well as more specific themes such as transitional justice, the responsibility of private security forces, the right of military occupation, psychology of the war criminal, etc.
This course will also work toward the preparation and eventual participation, by a team of 3 students in the Jean-Pictet International Humanitarian Law Competition, and a team of 2 students in the Inter-university Mock Trial Competition sponsored by the Belgian Red Cross. The selection of participants in these competitions will take place during May and June of the year prior to the competitions (See infra).
The 2 students selected for the Inter-university Mock Trial Competition will earn 6 supplementary credits. As concerns the course in international humanitarian law strictly speaking, they will be required to take the oral examination.
The 3 students selected for participating in the Jean-Pictet Competition will earn 15 supplementary credits. As regards the course in international humanitarian law strictly speaking, they will be required to take the oral examination. This competition takes place in two phases, a selection phase, including the production of an application dossier, and a competitive phase strictly speaking that includes an intensive training week. If the 3 participants do not become finalists, they will complete a 90 hour internship during the second semester on the theme of IHL, and the course instructors are committed to arranging and supervising this internship.
The Jean-Pictet Competition :(http://ww.concourspictet.org (http://ww.concourspictet.org/) ) This is a competition concerning IHL that involves Universities from every corner of the globe each year. Over and above the competitive aspect, it is also training for students, which aims at allowing them to increase their knowledge of IHL by giving them a form of hands-on knowledge through simulations and role-playing games. These games take place during an intensive week that pits the finalist teams against each other. Each team is made up of 3 candidates. Selection takes place in mid-November. The competition week takes place in March or April.
Inter-university Mock Trial Competition of the Belgian Red Cross:
(http://www.croix-rouge.be/Page.aspx?PageID=159) This competition, organized by the Belgian Red Cross for the last ten years, is for students in law, criminology, political science and international relations. A practical case is staged, featuring an armed conflict during which violations of international law are committed. After the conflict is over, the persons who committed the violations are brought before the International Criminal Court. Each university team of two students must take on the roles of prosecutor or defense counsel before the Court, here played by a jury of experts in IHL and drawn from academic, legal and international institutions. The competition involves a written phase, writing conclusions, and an oral phase, featuring an address delivered before the Court. |
