| Course contents : | The bulk of the course aims to explain the main rules governing patent law, at Belgian level (Act of 28 March 1984), European level (Munich Convention on the European Patent) and international level (Patent Cooperation Treaty). The following topics are covered: legal sources, subject matter and conditions of protection, assignment, scope of protection, including exceptions to rights and their duration.
The issue of biotechnological inventions will be further developed, as well as the protection of drugs by supplementary protection certificates (SPC's) and the protection of undisclosed data under regulatory law. Depending on availability, these topics may be dealt with in seminars organised with high profile practitioners.
The above study is preceded by a general introduction to IP law. We shall see how this field of law developed, explain which fundamental principles and major distinctions are governing it and think about the very nature of IP rights. In a final part, we will deal with the field of tension between IP law and the rules of the Internal market and fair competition enshrined within the EC Treaty. |

| Workshops : | Several practice and practical work sessions are organised during the academic year. They relate to solving case studies. The theoretical aspects are also the subject of reminders and clarifications.
Staff are on duty once a week: on Thursdays (from 09:00 to 18:30 except on practice days) or, at another moment by appointment only. Trifacultaire building, level +2, office 2.4, (in the Institut d'Etudes Juridiques Européennes "Fernand Dehousse" (IEJE)). |

| Organization : | Considering the fact that the course is also taken by 3rd year law students, the course is essentially taught in the form of ex cathedra lectures. Students are regularly asked to prepare for the following class by carrying out a reading task aimed at facilitating the examination of the most complex or most important questions in the subject. |

| Written notes : | Notes are posted on line on this website, as the course progresses. |

| Assessment : | The oral exam covers the entire subject. Students are allowed to have a copy of the statutory texts. |
