Course contents :  European Contract Law does not exist as such, but European law interferes with national contract laws in a number of ways. In particular, future contract lawyers need to be familiar with certain competition law rules as well as European consumer law. European contract law has also been in the past decade a very active field of legal scholarship. A number of studies have been undertaken and there have been several attempts at codifying existing law and emerging principles. The course deals with both existing and prospective European contract law. It will focus on contact points (possibly tensions) between rules of national contract law and EC rules which emerged in specific perspectives. In this respect the interplay of contract law with freedom of movement, competition rules and consumer protection will be given special attention. A shorter section of the course will be devoted to scholarly projects relating to European contract law. It will give an introduction to recent attempts at restating and codifying EC law and common principles of contract law.
Course objective :  This course aims to complement the study of internal law of contract and allow students to familiarise themselves with different perspectives on contracts. Il also aims at developping analytic capabilities in relation to policy issues underpining the development of contract law at European level.
Prerequisites :  Basic knowledge of internal market law. Basic knowledge of internal contract law of one member state.
Organization :  This course is offered in the second term. Students will have to prepare for each class by reading materials and/or preparing exercices which will be made available in advance.
Written notes :  A booklet containing reading materials will be available.
Students will receive instructions relating to course work as the course progresses.
Slides used for the oral lecture will be available via WebCT.
Assessment :  Oral exam and one written assignment or presentation.
