| Course contents : | 1. What the course is about Intellectual property rights are a legal tool to protect and validate innovation; that is their aim. This course aims to give students - the future managers of innovative projects and innovative companies - the basic notions of intellectual property allowing them to quickly identify a company's assets likely to be protected by an intellectual property right, and to take the necessary measures in time in order to effectively protect and validate them. 2. Contents dealt with The introductory part will allow students to situate the subject of intellectual property rights within its largely international general, economic and legal context. When the material has been sufficiently harmonized at the European level and even the world level, the student will be able to use the skills acquired in the course in the context of international work ; The protection system of the main intellectual property rights will then be studied in detail according to the following plan: - Protection of "technical" inventions (chemical, mechanical, electronic, etc.): patent - know-how - plant variety - Protection of artistic, literary and assimilated works: copyright, neighbouring rights, software, databases - Protection of "design" work: industrial drawings and models, copyright - Protection of distinctive signs: brand, trading name and ensign, corporate name, domain name, geographical information, quality label In the third and last part, we shall examine the validation of intellectual property rights: the contracts most frequently used in this domain (licensing contracts, etc.), internal organisation measures (in order to create and channel innovations and thus prevent them from disappearing to the detriment of the company) and finally, the legal or extralegal protection of intellectual property rights, especially the effective descriptive seizure procedure. |
 |
| Course objective : | As a result of this course, students should be able to: - identify the intellectual property right(s) likely to protect and validate all or part of an innovative project (product, procedure, method, design, computer program, etc.), its communication and its marketing (brand, marketing campaign, website, etc.), and to justify their choice (C4); - describe the steps to be taken / research to be carried out to obtain the best protection and validation (P2); - read a contract (in terms of confidentiality, licensing, technology transfer, etc.) from the point of view of one of the parties with a critical eye, assess whether the contract adequately reflects its objectives and does not include any risks or unjustified commitments (C4) |
