Course contents :  The aim of the course, intended for non-jurists, is to describe, in it's broad outline, the legal status applicable to organisation and operation of economy. The links with other disciplines, such as economy and history, are priviledged, to adapt the subject to student¿s needs and interests for human sciences. After a general introduction, the course centers around the fundamental trilogy of the liberal economy system such as the one existing today in Belgium, and more widely, in the European Union : enterprise, market and risk. The course will consider the various ways according which these concepts are translated and used in business law. At first, the enterprise received a legal translation through the idea of tradesman which triggers the application of a certain number of rules (competence of the commercial courts, particular ways of evidencs, insolvency law). This translation was later on exetended to all other entities exercising an economic activity. Between them, commercial companies will specially be pointed out. The organisation and operation of the market will be considered in the second chapter of the course : freedom of trade and industry principle, establishement law, competition law, trade practices and regulation of prices, and an introduction to the organization of financial markets and to the operation of financial institutions. Finally, in a third part, the insolvency and « concordat » law will be examinated, as a legal instrument of sanction of the economic agent's failing.
Course objective :  The aim of the course is to provide the students with a theoretical knowledge (ex. : links with the underlying economic talkings and with some important matters of law theory), but also practical knowledge (ex : concrete practices of companies) to enable them to understand the stakes of the important contemporary economic evolutions. The aim is to enable them to situate their non-legal knowledge in relationship with the current talkings of « law makers » (legislator, judges, authors) on the organisation and operation of economy.
Organization :  The course will take place during the second "quadrimestre".
