Course contents :  Going to the courts is the classic way of resolving disputes. The course ¿Arbitration and alternative dispute resolution¿ deals with the alternative ways which are developing every day.
First it will be necessary to define them and make the necessary distinctions (arbitration, negotiation, mediation, conciliation, mini-trial, etc.). Then it will be possible to study their legal regime.
The purpose of the course is to enable the students to determine, in consideration of the circumstances of a case, which way is the best to resolve a dispute.
The focus will be on arbitration.
Prerequisites :  General knowledge of law.
Organization :  1e semester
Written notes :  Notes and references to relevant case law and authors will be available.
Assessment :  Oral examination.

With the agreement of Mr. Caprasse, students may write a paper instead of the exam.
