Introduction to Judiciary Law: the Institutions

Course contents : The first part deals with the fundamentals governing the civil procedure.
The second part is devoted to a detailed description of each jurisdiction.
The third part deals with those persons involved in the judicial system.
Course objective : Understanding judicial powers from the point of view of the citizen.
Prerequisites : None
Organization : Lectures and tutorials take place during the first quarter of the year
Written notes : Students are provided with a syllabus, which is available at the « Point de vue ».
Only the subjects taught in class will be examined.

Assessment : In the first as well as the second session, there will be a written exam composed of essay questions, followed by a compensatory oral exam. This compensatory exam is open to all students.

There are three different types of question :
1.- defining legal terms
2.- questions on general theory
3.- problem questions

The exam requires not only knowledge of the course but also its understanding. Questions asked during previous exams as well as the scheme to be followed are discussed with a tutorial student during the revision classes.

The answers must be clear, precise and to the point.

Examples of questions :

1. A, metal worker, is the victim of an accident at work. He sues his employer before the president of the employment Tribunal in order to engage an expert as well as a provisional sum of 3.500 euros in order to cover the cost of surgery he will have to undergo.

A. The judge will be competent in relation to which conditions ? Explain.
B. What are the characteristics of the future decision from the point of view of its durability and ifs effectiveness ? Explain.

C. Would he have been able to bring an action before the president of another jurisdiction ?

2. Explain the hybrid character of the status of the « ministère public » (first session 1997-1998 exam).
