| The Treaty of Rome did already contain several provisions related to company law. These provisions where sometimes maintained, sometimes improved, even supplemented, and did widely evolve in relation with the interpretations given by the Court of Justice of the European Communities. In addition, new legal instruments appeared, with the creation of the European Economic Interest Grouping, the European Cooperative company and the European Company. Finally, on the ground of several provisions of the EC Treaty (again in theEUF Treaty), attempts of partial harmonization of the Member state's company law were realised through several directives. There also, the Court of Justice had to intervene to enlighten the significance of the text. Relevant provisions of primary law, directives, putting into place of uniform companies structrures, and judicial decisions of the Court of Justice : these are the four aspects of european company law highlighted by this course. |
