| Course contents : | The course deals with estate planning, both on a civil and tax level, from a theoretical and practical point of view.
The aim of the course is to answer the following questions in a concrete manner: how to organise the transfer of assets composed of buildings, financial assets, and even a company? How to reduce the bill for succession rights? How to maintain sufficient control over the transferred assets? How to guarantee the donor a sufficient flow of income?
The general aspects of family property law are included: matrimonial regimes, successions, gifts, private international law.
This is a chance to evoke concepts such as forced heirship, tontine, legal cohabitation, life interest.
A substantial part of the course is dedicated to the main instruments of estate planning (marriage contract, donation, will), as well as its accessories (expatriation, life assurance, company, credit, trustee mechanisms).
In order to place this course under a resolutely practical light, we envisage several cases of estate planning: e.g. for a property owner, a company director, someone who is handicapped, a co-inhabitant, etc.
Within this framework, we shall analyse what the following are: a cultural heritage society, a foundation, a trust, an administrative office.
The subject is illustrated through numerous exercises requiring the students' active participation. |

| Course objective : | At the end of the course, students will be able to establish a patrimonial diagnosis and offer legal and tax advice to private individuals keen to optimise the transfer of their movable and immovable property to their heirs. |

| Organization : | The course is organised on Saturdays from 09:00 to 13:00 (14:00 the two latest Saturdays), from 20 February to 3 April 2010. It combines theoretical lectures and practical work. |

| Written notes : | Slides including the summary notes from the classes, accompanied by a documentation file |

| Assessment : | Oral exam
Types of questions: - reflection questions (possibly open book);
- analysis and comments on documents (marriage contract, will, etc.); - case studies. |
