| Aperçu général : | Law and Art: The Free Movement of Cultural Property This course offers participants the opportunity to become acquainted with a very special area - that of the international art trade and the relevant law. Many different fields of law are relevant for the international art trade, e.g. private law, international private law, European law, international law and criminal law. In the past few years many international and European legal instruments dealing with the protection of cultural property have been adopted, such as the EC regulation on the export of cultural goods (1992), the EC directive on the return of cultural object unlawfully removed of the territory of a member state (1993), the UNIDROIT Convention on Stolen or Illegally Exported Cultural Objects (Rome, 24 June 1995), and the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property. After mulling over which of these conventions to ratify, the Netherlands finally decided in favour of the 1970 UNESCO Convention and are planning to ratify this Convention in the near future. What all these legal instruments have in common is that they have serious consequences for the international trade in art and cultural objects. In the first week there is a general introduction in which the organisation of the course is discussed and students will begin to work on the international art trade and the relevant law. | ||||||||
