Property Law: Further Study and Application Exercises

Course contents : The class is made of various parts whose order may vary from one year to another. First, the topic of statutory easements will be studied, especially the easements of “enclave”, the distances that should be respected for planting and easements related to water (partly). A second theme concerns two immovable real rights that are frequently used in today’s practice: surface right and emphyteusis. Finally the Statute governing divided co-ownership of immovables will of course be examined, as well as the statute governing the building of dwellings and the sell of dwellings to be constructed, and the timeshare Act. A possible final part would encompass the notions of trust and “fiducie”.
Course objective : From a deep study of real estate, focusing partly on traditional matters that have not been studied in previous classes (easements arising from statutes, surface right, emphyteusis…) and partly on specific matters related to immovable property, the class aims at making students familiar with law cases, doctrine research, critical analysis as well as the techniques of argumentation. It also aims at providing students in notary with the necessary basis of real estate.
Prerequisites : Property law. Partim civil law
Organization : Lessons (2X2 hours a week) during the second semester.
Written notes : Detailled plan.
Assessment : Oral exam in may/june of, if necessary, in august/september. Civi code and list of legal dispositions.
